This End User License Agreement (EULA) is a legal agreement between you and Ludicon LLC ("Ludicon", "us" or "we") and governs your use of spark.js (the "Software"), a real-time GPU texture compression runtime library and set of shader codecs.
This EULA grants you the right to use the Software without payment for personal (hobbyist), educational (students and teachers), or other Non-Commercial use, subject to the following conditions:
spark.js may only be integrated and redistributed as part of a web application (the "Product");
spark.js may not be distributed as part of a game engine, development toolkit, or middleware;
spark.js may not be used in any commercial enterprise, production, or subcontracting, except for internal evaluation purposes without public deployment or distribution;
Non-Commercial use must not involve any form of monetization, sponsorship, advertising, or promotional partnerships;
The Product must include attribution in accordance with Clause 2.
This EULA does not grant you the right to use the Software for any other commercial purpose. A commercial license must be obtained from Ludicon by contacting spark@ludicon.com. For details, refer to ludicon.com/sparkjs#Licensing.
We ask that your Product visibly includes the following attribution to spark.js:
“Powered by spark.js⚡️”
This attribution must include a hyperlink to https://ludicon.com/sparkjs/ and be visible to end users of your Product.
Commercial users may obtain an attribution waiver as part of a separate commercial license.
Ludicon retains all right, title, and interest in and to the Software, including all intellectual property rights. This EULA does not grant any ownership interest. You may not remove or alter any copyright, trademark, or attribution notices included with the Software.
We welcome suggestions and improvements. By submitting any feedback, modifications, or public contributions to the Software, you grant Ludicon a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, incorporate, and distribute such contributions as part of the Software or related offerings.
The Software is provided “as is” without warranty of any kind. Ludicon disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by law, Ludicon shall not be liable for any direct, special, indirect or consequential damages whatsoever resulting from loss of data or profits, whether in an action of contract, negligence or other tortious conduct, arising out of or in connection with the use or performance of the Software, even if advised of the possibility of such damages.
This EULA shall be governed by the laws of the State of California. If any portion of this Agreement is deemed unenforceable by a court of competent jurisdiction, it shall not affect the forcibility of the other portions of this Agreement. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in Yolo County, California.
